Terms of service
SELVE — Terms of Service
Last updated: 15 september 2026
Overview
Welcome to SELVE. The terms "we", "us" and "our" refer to SELVE, a sole proprietorship established in the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number 42153898. SELVE operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). SELVE is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights, your right of withdrawal, our liability, and how to file a complaint.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.
Nothing in these Terms limits or excludes your mandatory rights as a consumer under Dutch or European Union law. Where a provision of these Terms conflicts with those rights, your statutory rights prevail.
Section 1 — Access and account
By agreeing to these Terms, you confirm that you are at least 18 years of age. If you are under 18, you may only use the Services with the consent of a parent or legal guardian. You are responsible for any use of the Services by minors in your care on devices you own or manage.
To use the Services, including browsing our store or purchasing products, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You confirm that the information you provide is correct, current and complete, and that you are entitled to provide it.
You are responsible for keeping your account credentials secure and for activity that takes place through your account. You may not transfer, sell, assign or license your account to anyone else.
Section 2 — Our products
SELVE sells cosmetic products. We have made every effort to represent our products accurately in our online store. Please note that colours and product appearance may differ somewhat from how they appear on your screen, depending on your device and its settings. This does not affect your statutory right to receive a product that conforms to the contract (see Section 17).
Ingredients and sensitivity. The full ingredient list (INCI) is shown on each product page and on the packaging. Cosmetic products can cause a reaction in people with sensitive skin or specific sensitivities. Please read the ingredient list before use, follow the instructions on the packaging, and consider testing a small amount on a discreet area of skin first. Discontinue use if irritation occurs and consult a doctor or pharmacist if it persists.
No medical claims. Our products are cosmetics intended for cleansing, protecting, perfuming or changing the appearance of the skin, lips, eyes, hair or nails. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or condition.
Product safety. Our products comply with Regulation (EC) No 1223/2009 on cosmetic products. [INSERT NAME] acts as the Responsible Person for the products in our range, and each product has been subject to a safety assessment and notified through the EU Cosmetic Products Notification Portal (CPNP) before being placed on the market.
Product descriptions may change over time. We may discontinue any product, and we may limit the quantities we offer to any person, region or jurisdiction.
Section 3 — Orders
When you place an order you are making an offer to purchase. A contract is formed once we confirm acceptance of your order, normally by email. We may decline an order — for example if a product is out of stock, if we cannot verify your details, or if there is a pricing error — and we will tell you as soon as possible using the contact details you provided.
If we cannot accept your order, or accept only part of it, we will not charge you for the part we cannot supply, and we will refund any amount already paid for it without delay.
Once an order has been accepted we may not be able to change or cancel it before dispatch. This does not affect your right of withdrawal, which is described in our Returns and Refunds Policy [LINK] and in Section 6 below.
Returns and exchanges are governed by our Returns and Refunds Policy [LINK], which forms part of these Terms.
Our products are sold for personal use. We may refuse or limit orders that appear to be placed for commercial resale.
Section 4 — Prices and payment
All prices shown in our store are in euros and include Dutch VAT at the applicable rate. Shipping costs are shown separately before you complete your order, and the total amount payable is confirmed to you before you place the order.
Prices, discounts and promotions may change at any time. The price that applies to your order is the price shown at the time you place it, as set out in your order confirmation.
Orders shipped outside the European Union may be subject to import duties, taxes or customs charges in the destination country. These are not included in our prices and are your responsibility.
From time to time we may run promotions with their own terms and conditions. Where promotion terms conflict with these Terms, the promotion terms apply to that promotion.
We accept the payment methods shown at checkout. You confirm that you are authorised to use the payment method you select and that the payment details you provide are accurate. Payments are processed by Shopify Payments and other third-party payment providers; your use of those services may be subject to their own terms.
Section 5 — Shipping and delivery
We aim to dispatch orders within 2 working days. Unless we have agreed otherwise with you, we will deliver your order within 30 days of the day after the contract is formed.
If we cannot deliver within that period, you may give us an additional reasonable period to deliver. If we still fail to deliver, you may cancel the contract and we will refund all amounts you have paid without delay.
Delivery times shown in our store are estimates. We depend on external carriers and we are not responsible for delays caused by the carrier, customs processing or other circumstances beyond our reasonable control. We will keep you informed and help you trace a delayed parcel.
Risk of loss. The risk of loss or damage passes to you at the moment you — or a third party you have designated, other than the carrier — take physical possession of the products. If your order arrives damaged, or does not arrive at all, please contact us at info@shopselve.com and we will resolve it.
If you have designated your own carrier rather than one we offer, the risk passes to you when the products are handed to that carrier.
Section 6 — Right of withdrawal and returns
As a consumer in the European Union you have the right to withdraw from your purchase within 14 days of receiving it, without giving a reason.
Because our products are cosmetics that come into direct contact with the skin, lips and eyes, the right of withdrawal does not apply to products whose hygiene seal has been broken after delivery (Article 6:230p of the Dutch Civil Code). Sealed, unused products in their original packaging can be returned.
Full details — how to withdraw, where to send a return, who pays return shipping, and how refunds are processed — are set out in our Returns and Refunds Policy [LINK]. A model withdrawal form is available there and is also included with your order.
Your right of withdrawal is separate from, and in addition to, your statutory rights in respect of faulty or non-conforming products (Section 17).
Section 7 — Intellectual property
Our Services, including all trademarks, brand elements, text, images, graphics, video, audio and the design, selection and arrangement of them, are owned by SELVE or its licensors and are protected by Dutch, EU and international intellectual property law.
These Terms permit you to use the Services for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish or commercially exploit any material from the Services without our prior written consent. Nothing in these Terms grants you a licence or any other right under any trademark, copyright, design right, database right or other intellectual property of SELVE, Shopify or any third party. All rights not expressly granted are reserved.
The SELVE name, logo, product names and designs are trademarks or trade names of SELVE. You may not use them without our prior written permission. Shopify's name, logo and product names are trademarks of Shopify. All other names and marks appearing on the Services belong to their respective owners.
You may share links to our store and use our product images for ordinary personal purposes such as reviews or social media posts, provided you do not suggest that we endorse you and do not alter the images in a misleading way.
Section 8 — Optional tools
You may be given access to tools provided by third parties as part of the Services, which we do not monitor and over which we have no control.
We provide access to such tools as they are made available to us, without any warranty or endorsement on our part. Use of these tools is at your own discretion, and you should make sure you are familiar with the terms on which the third-party provider offers them.
We may add new features and tools to the Services in future. These will also form part of the Services and will be subject to these Terms.
Section 9 — Third-party links
The Services may contain links to, or embedded functionality from, websites operated by third parties. We do not review or verify the content or accuracy of third-party materials or websites. If you choose to leave our Services to access them, you do so at your own risk.
We are not responsible for the content of third-party websites or for products or services you purchase from them. Please review the third party's own terms and privacy practices before entering into any transaction. Questions or complaints about third-party products and services should be directed to that third party.
Nothing in this section limits our own responsibility for the products we sell you or for the content of our own store.
Section 10 — Relationship with Shopify
SELVE is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with SELVE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SELVE, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SELVE.
Section 11 — Privacy
All personal data we collect through the Services is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Certain personal data may also be processed by Shopify under its own privacy policy.
Because the Services are hosted by Shopify, Shopify collects and processes personal data about your use of the Services in order to provide and improve them. Information you submit may be transmitted to Shopify and to other processors, which may be located outside the Netherlands, in order to provide the Services to you. Our Privacy Policy explains what data we collect, why, how long we keep it, and how you can exercise your rights of access, rectification, erasure, restriction, portability and objection.
Section 12 — Reviews and feedback
If you submit a review, suggestion, idea, image or other content (together, "Feedback"), you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, publish, distribute and display that Feedback for the purpose of operating, evaluating, improving and promoting the Services, including in our marketing. You retain ownership of your Feedback. Where we use your Feedback in marketing and it identifies you, we will ask for your consent first.
You confirm that you own or are entitled to submit your Feedback, that it is your own genuine experience, and that you have disclosed any payment, free product or other incentive you received in connection with it. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.
We may remove Feedback that we consider unlawful, misleading, abusive, obscene, defamatory, or in breach of someone else's rights or of these Terms. We do not remove reviews simply because they are negative, and we do not publish reviews we know to be fake.
Your Feedback must not infringe anyone's rights, contain unlawful or abusive material, or contain malicious code. You may not use a false email address or misrepresent who you are. You are responsible for the Feedback you submit.
Section 13 — Errors, inaccuracies and omissions
Our store may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery times or availability. We reserve the right to correct such errors and to update information at any time without prior notice.
If a manifest error — such as an obviously incorrect price — affects an order you have already placed, we may cancel that order and refund you in full. We will not cancel an order on this basis where the error was not obvious and you could reasonably have relied on the information as correct.
Section 14 — Acceptable use
You may access and use the Services for lawful purposes only. You may not use the Services: for any unlawful or malicious purpose; to breach any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, defame, intimidate or harm any person; to transmit false or misleading information; to send advertising, spam, chain letters or similar solicitations; to impersonate any other person or entity; or to interfere with anyone else's use of the Services.
You also agree not to: upload or transmit viruses or other malicious code; reproduce, copy, extract, resell or exploit any part of the Services; collect or track other people's personal data; phish or pretext the Services; use any robot, spider, scraper, data-gathering tool, AI agent or other automated means to access the Services except as permitted in Section 15; or interfere with, bypass or circumvent our security measures, robot exclusion headers or other access restrictions.
We may suspend or terminate your access to the Services if you materially breach this section.
Section 15 — Automated agents
15.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any of the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, and that can run without direct supervision.
15.2 An Agent may only access, use or interact with the Services if it identifies itself and operates in accordance with clause 15.4 at all times. An Agent may not access the Services if we have asked it to refrain from doing so.
15.3 We may limit, including by technical means, whether and how any Agent accesses, uses and interacts with the Services.
15.4 Agents must: (i) identify in all HTTP/HTTPS requests that the request comes from an Agent and disclose its name, by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that the access or interaction comes from an Agent, including by mimicking human behaviour or interaction patterns, or by completing or circumventing CAPTCHAs or other measures intended to distinguish humans from machines; (iii) answer truthfully any question or prompt seeking to establish whether the interaction comes from a human or a machine; and (iv) not circumvent or avoid any measure intended to block, limit, modify or control how Agents access the Services.
Section 16 — Suspension and termination
We may suspend or withdraw access to the Services, in whole or in part, for technical, security, legal or operational reasons, or if you materially breach these Terms. Where reasonably possible we will give you notice.
Termination does not affect any order already accepted, your right of withdrawal, your statutory rights in respect of products already delivered, or any amounts due up to the date of termination.
The following sections continue to apply after termination: Intellectual Property, Reviews and Feedback, Suspension and Termination, Statutory Guarantee, Liability, Indemnity, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Jurisdiction, Privacy, and any other provision that by its nature should survive.
Section 17 — Statutory guarantee (conformity)
We must deliver products that conform to the contract: products that correspond to the description, quantity and quality agreed, that are fit for the purpose for which cosmetics of that kind are normally used, and that are supplied with the packaging and instructions you can reasonably expect. This is your statutory right under Articles 7:17 and following of the Dutch Civil Code, and it applies in addition to the right of withdrawal.
If a product does not conform — for example if it is defective, damaged on arrival, not what you ordered, or has passed its period of minimum durability or its PAO on delivery — you are entitled to have it repaired or replaced, or, where that is not possible or proportionate, to a price reduction or to cancel the contract and receive a refund. We bear the cost of returning a non-conforming product.
Please contact us at info@shopselve.com with your order number and, where possible, photographs. Reporting a problem promptly after you discover it helps us resolve it quickly.
Information about cosmetic products — including ingredients, warnings, period after opening and date of minimum durability — is provided on the product page and on the packaging. This information is not a commercial guarantee and does not limit your statutory rights.
Section 18 — Liability
We are liable for damage caused by a failure to perform our obligations under the contract, and for damage caused by a defective product, in accordance with Dutch law.
Subject to that, and to the fullest extent permitted by law:
- We are not liable for indirect or consequential loss, including loss of profit, loss of revenue, loss of savings or loss of data, arising from your use of the Services.
- We are not liable for damage resulting from use of a product contrary to the instructions or warnings on the packaging or product page, or from continued use after a reaction has occurred.
- We are not liable for the content, availability or security of third-party websites, tools or services linked to or embedded in the Services.
- We do not guarantee that the Services will be available without interruption or free of errors, and we are not liable for loss caused by temporary unavailability of the store.
Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, for intent or gross negligence on our part, for our liability as a producer under Dutch product liability law, or for anything else that cannot lawfully be excluded or limited.
Section 19 — Indemnity
You are liable to us for loss we suffer as a result of your intentional or negligent breach of these Terms, your infringement of our or a third party's rights, or your unlawful use of the Services. This does not extend to loss we would have suffered in any event, and it does not apply where the loss results from our own act or omission.
Section 20 — Complaints and disputes
We want you to be satisfied with your purchase. If something is wrong, please email us at info@shopselve.com with your order number and a description of the problem. We will confirm receipt within 5 working days and aim to respond substantively within 14 days. If we need longer, we will tell you when you can expect an answer.
A complaint made to us does not suspend your statutory rights or any applicable time limits.
If we cannot resolve your complaint together, you may take the matter to the competent Dutch court (see Section 24). Consumers in the Netherlands can also obtain free, independent information about their rights from ACM ConsuWijzer (www.consuwijzer.nl). Consumers in other EU countries can contact their national consumer authority or a European Consumer Centre.
Section 21 — Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will apply to the fullest extent permitted by law, and the unenforceable part will be treated as severed. This does not affect the validity or enforceability of the remaining provisions.
Section 22 — Waiver and entire agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Returns and Refunds Policy and Privacy Policy, constitute the entire agreement between you and us in respect of your use of the Services, and replace any earlier agreements or communications between us on the same subject, including any earlier version of these Terms.
Section 23 — Assignment
You may not transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent. We may transfer or assign these Terms and our rights and obligations under them, provided this does not reduce the guarantees or rights you have as a consumer. We will notify you if we do.
Section 24 — Governing law and jurisdiction
These Terms and any contract formed under them are governed by the law of the Netherlands.
Disputes arising out of or in connection with these Terms may be brought before the competent court in the district where SELVE is established.
If you are a consumer resident in another EU Member State, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in the courts of your own country. We will only bring proceedings against you in the courts of your country of residence.
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
Section 25 — Changes to these Terms
You can always review the current version of these Terms on this page.
We may update or replace these Terms by posting a revised version on our website. The version in force at the time you place an order is the version that applies to that order; later changes do not apply retroactively to orders already placed. Where required by law, we will notify you of material changes before they take effect.
